What Is Mediation?

Mediation uses a neutral party trained in mediation techniques to avoid problems that can end up in litigation. Through education and communication, problems are resolved as you are guided to a mutually agreeable settlement. From personal injury claims to business disagreements, mediation is often very effective. The process of mediation can save you from extended time in court and thousands of dollars in legal fees. Does a mediator determine who is right and wrong?

No. The mediator does not make a judgment about who is right or wrong. They help find a compromise to end the argument and negotiate a deal on your own terms. The goal is to put the problem behind you and avoid the time and expense of litigation.

A good mediator convinces the parties that through an informed process of give and take, they can arrive at a mutually beneficial settlement. However, the mediator only facilitates the discussion. He or she does not issue a binding judgment or decision.

How Long Does Mediation Last?

The length of time for mediation can vary.

In most cases, a settlement is reached in a single session, taking between one and four hours. However, in a more complicated dispute, it might take multiple sessions and several days to settle. 

The length of time depends on how complex the situation is and/or the nature of the legal dispute involved. Who pays for the mediation?

In most cases, the cost of mediation is shared equally by all parties involved.

Informal. Many mediations now take place over Zoom or in an informal setting rather than in a courtroom setting.  The informal setting allows a relaxed atmosphere for engaging in productive settlement discussions.

Confidential. California law requires that all communications made in the course of mediation are protected and shall remain confidential. This protection allows for and encourages parties to explore all possibilities to reach a compromise.
